1. Preamble & Scope of Agreement

This Affiliate Partner Agreement (referred to as the "Terms & Conditions") constitutes a legally binding understanding between WebiMitra Platform ("Company", "We", "Us") and the registering affiliate partner ("Partner", "You"). By submitting your affiliate registration and ticking the agreement acceptance box, you explicitly agree to adhere to all policies, codes of conduct, and commission guidelines herein.

2. 100% Free Partner Onboarding

Enrolling in the WebiMitra Affiliate Program is strictly 100% free. You are NOT required to purchase any paid subscription, store software, or merchant plan to earn commissions. Any user can sign up purely as an independent affiliate partner and generate earnings through verified referrals.

3. Dynamic Multi-Tier Commission Distribution

WebiMitra operates an advanced multi-tier affiliate tracking engine:

• Commissions are calculated dynamically based on active product rules configured by the platform.
• Tracking is attributed via your unique referral code or link with cookie persistence within the defined attribution window.
• Upline multi-level commissions are distributed transparently up to the maximum permitted hierarchy depth.

4. Anti-Fraud & Strict Code of Conduct

To protect platform integrity, data privacy, and genuine partners, the following activities are strictly prohibited:

• Self-Referral Prohibition: You may not purchase products, subscriptions, or stores for yourself using your own affiliate link to claim discounts or commissions.
• No Fake / Bot Traffic: Automated bot clicks, click-farming, cookie-stuffing, or deceptive iframes will trigger immediate automated blacklisting.
• No Brand Hijacking (PPC): Bidding on trademarked keywords (e.g. "WebiMitra", "WebiMitra Login") on Google Ads or search engines without written authorization is prohibited.
• No Spam or Misrepresentation: Bulk spamming via email, WhatsApp, or unsolicited SMS is forbidden. You must accurately represent WebiMitra services without making false earnings claims.

Any violation results in immediate account suspension, permanent forfeiture of accrued wallet balances, and potential legal recourse.

5. Wallet, KYC & Payout Regulations

Withdrawals and payouts are governed by standard financial compliance:

• Cooling / Hold Period: Commissions may be held in a pending state during the customer guarantee/refund window (e.g., 7–14 days) before becoming available in your main wallet.
• Mandatory KYC: Prior to processing bank transfers or UPI payouts, partners must complete standard KYC verification (Government ID, PAN/GST, Bank account proof) as mandated by Indian financial guidelines.
• Minimum Threshold: Payout requests can be submitted once your available wallet balance meets or exceeds the defined minimum payout threshold.
• Tax Deductions (TDS): Applicable TDS or statutory deductions will be processed as per prevailing tax laws.

6. Refund & Chargeback Clawbacks

If a referred customer cancels, receives a refund, or disputes a transaction (chargeback), all commissions distributed across all tiers for that transaction will be automatically reversed (clawed back) from the respective affiliate ledgers.

7. Privacy & Confidentiality

Partners must maintain strict confidentiality regarding platform metrics, proprietary technology, customer contact information, and internal operations in compliance with the Digital Personal Data Protection (DPDP) Act and Information Technology Act.

8. Independent Contractor Status

Nothing in this Agreement shall create an employment, partnership, joint venture, or agency relationship. You act solely as an independent affiliate partner.

9. Program Modification & Termination

WebiMitra reserves the right to modify commission structures, terms, or terminate partner accounts for policy non-compliance upon written or electronic notice.
